Southwest Strings Rental Agreement

  1. The customer agrees to rent the instrument(s) for a minimum of three months. The first three month's rental fees are due when the instrument is rented; these fees are non-refundable.

  2. In the fourth month and thereafter, we will charge the rental fee to the credit card listed below between the 1st and 6th of the month.

  3. Billing:

    1. If you rent on or before the 16th of the month, you will pay rent for that month. If you rent on or after the 17th of the month, you will be charged for the following month.
    2. If we receive your returned instrument on or before the 16th of the month, you will not be charged for that month. If we receive it on or after the 17th, you will be charged for that month.
  4. Failure to pay any monthly installment constitutes default and will entitle Southwest Strings to demand immediate payment of the full amount outstanding and start collection proceedings. Customer agrees to pay all collection costs, including court costs, and reasonable attorneys' fees as allowed by law.

  5. There is no penalty for prepayment.

  6. The rental customer pays all freight charges related to receipt, exchange and return. Current shipping rates are $20.95 for each violin or viola, $52.95 for each cello, $35.00 for each guitar, $30.00 for each Vihuella and $125.00 for each Guitarron.

  7. Customers residing outside the Tucson city limits must obtain insurance for any rental instrument. Customer must show proof of insurance prior to renting an instrument. Insurance protects the instrument against fire, flood, theft (police report required), and major catastrophe. Should the instrument require general repairs, including bridge work, pegs, fingerboards, and cracks, the customer pays to ship the instrument to Southwest Strings for the repairs, and Southwest Strings pays for the costs of parts and labor. Once Southwest Strings receives the returned instrument, a new one will be shipped to the customer. The new instrument is covered under all terms of the rental agreement. If customer chooses not to obtain insurance he/she will be liable for all damage, loss, theft to the instrument.

  8. Customers residing inside the Tucson city limits may obtain insurance for any rental instrument. Should the customer decline to obtain insurance prior to renting an instrument, the customer is liable for any loss, damage or theft to the instrument. Customer will be charged the full amount of the instrument. Southwest Strings will not be liable for any loss, damage or theft to the instrument except general repairs, including bridge work, pegs, fingerboards, and cracks. If general repairs are needed the customer pays to ship the instrument to Southwest Strings for the repairs, and Southwest Strings pays for the costs of parts and labor. Once Southwest Strings receives the returned instrument, a new one will be shipped to the customer. The new instrument is covered under all terms of the rental agreement.

  9. This is a not a rent-to-own program. Renter’s credit is applied as follows:

    1. Your credit is 100% of all rental fees paid in the first five months and may be applied towards the purchase of the rental instrument, or a different new or used instrument of equal or higher value. Insurance premiums and shipping charges are not counted towards renter’s credit.
    2. Renter’s credit does not include the monthly insurance fee and will never exceed a total of five monthly payments, regardless of the length of time the instrument is rented.
    3. Your rental credit is good for one year. After one year customer must reapply for credit.
  10. All rental instruments must be returned to Southwest Strings, 1721 S. Cherrybell Strav., Tucson, AZ. All unpaid rental fees and shipping fees will be charged to the customer once Southwest Strings receives the instrument.

  11. Once an instrument is returned, Southwest Strings will assess whether the rental instrument has been damaged in any way. Should the instrument be damaged, in any way other than normal wear, customer will be responsible for that damage and the cost to repair the damage will be charged to the customer using the credit card provided in this Rental Agreement.

  12. String basses can only be rented locally in Tucson, AZ. We do not ship rental basses.

  13. Customer waives presentment, demand, protest, notice of dishonor or any other notice of any kind, all of which are hereby waived.

  14. Delay in the enforcement of Southwest Strings' rights under this Rental Agreement shall not be construed as a waiver of any right.

  15. If I do not comply with the terms of this Agreement, Southwest Strings reserves the right to terminate this agreement without notice, repossess instrument(s), and pursue any necessary legal action.

  16. This Rental Agreement may be assigned by Southwest Strings.

  17. In the event of legal action, exclusive venue shall lie with a court of competent jurisdiction in Pima County, Arizona. Any provision in this Agreement providing for arbitration is null and void. Should we engage counsel to enforce any provision of this Agreement, the rental customer agrees to pay all reasonable attorneys' fees, court costs, and related expenses.
